Welcome to Imparted. These Terms of Service ("Terms") govern your use of the Imparted iOS app, the imparted.io website, and any questionnaire link Imparted generates (collectively, "the Service"). The Service is operated by Chill LLC, an Arkansas limited liability company ("Imparted," "we," "us," or "our"). By using the Service, you agree to these Terms.

What Imparted does

Imparted helps you give better gifts. You add a recipient, send them a short questionnaire link, and Imparted uses their answers to generate a curated gift shortlist currently sourced through Amazon. Recipient profiles can be saved in your private circle so future gifts take seconds.

Accounts

To use most features of Imparted, you must create an account. You agree to:

• Be at least 18 years old (or the legal age of majority in your jurisdiction)
• Provide accurate information when creating your account
• Keep your login credentials secure
• Be responsible for activity on your account

You may use supported sign-in methods, including Google sign-in or email-link sign-in, to authenticate. Imparted receives the email address and any basic profile information shared through the selected sign-in method.

Billing

Imparted offers paid subscriptions. Pricing is shown in the Service and is currently:

• Monthly subscription: 7-day free trial when eligible, then $1.95 USD per month for the first 3 months, then $4.99 USD per month
• Annual subscription: 7-day free trial when eligible, then $39.99 USD per year

Web payments are processed through RevenueCat Web Billing and Stripe. Subscription trials require a payment method. By starting a subscription trial, you authorize Imparted to charge the displayed subscription price after the trial ends unless you cancel before then. Subscriptions automatically renew at the end of each billing period unless canceled before renewal.

You can manage or cancel your subscription through the account or billing flow made available in the Service, or by contacting us. Cancellation takes effect at the end of your current billing period; you retain access until then. We do not offer refunds for partial subscription periods except where required by law or handled through the payment processor.

Pricing may change with reasonable notice. Existing subscriptions will continue at the original price until the next renewal, after which the new price applies.

How recipient information is used

When you add a recipient to your circle and send them a questionnaire link, you confirm that:

• You have the recipient's permission to ask them to fill out the questionnaire on your behalf
• You will not use Imparted to harass, surveil, or otherwise misuse another person's information
• Information collected through the questionnaire is used solely to generate gift suggestions for that recipient and is not shared outside your account

Misuse of recipient information may result in account termination.

Affiliate links

Imparted earns affiliate commissions from qualifying Amazon purchases when you click an Amazon gift link in the app. This does not change the price you pay at Amazon. See our Affiliate Disclosure for full details.

Acceptable use

You agree not to:

• Use the Service to violate any applicable law or third-party right
• Attempt to reverse-engineer, decompile, or extract the Service's source code or AI prompts
• Use automated systems (bots, scrapers, crawlers) to access the Service except as expressly permitted
• Submit content that is harassing, defamatory, obscene, or illegal
• Resell or redistribute the Service or its outputs
• Bypass usage limits, rate limits, or subscription checks

Intellectual property

Imparted (the name, the logo, the wordmark, the brand voice, the AI prompts, the visual identity, and the source code) is the intellectual property of Imparted and its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use as long as you comply with these Terms.

You retain ownership of the content you create within the Service (e.g., notes about a recipient). By using Imparted, you grant us a limited license to store and display that content within your account so the Service can function.

AI-generated content disclaimer

Imparted's gift suggestions are generated by an artificial-intelligence model (Anthropic's Claude) using the information provided in the questionnaire. AI suggestions:

• Are recommendations, not guarantees of fit, suitability, availability, or appropriateness
• May reflect biases or errors inherent in language models
• Do not constitute professional, medical, financial, or legal advice

You are responsible for reviewing each suggestion and deciding whether to make a purchase. Imparted does not warrant that suggestions will be accurate, current, or available at the prices shown.

Retailer responsibility

When you click a gift link, you leave Imparted and arrive at Amazon or another third-party retailer if additional retailers are added later. Pricing, availability, shipping, returns, customer service, and product quality are the responsibility of that retailer, not Imparted. Their terms and privacy policies apply to your activity there.

Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Imparted does not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

Limitation of liability

To the maximum extent permitted by law, Imparted shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Imparted's total liability to you for all claims arising under or related to the Service shall not exceed the amount you paid Imparted in the twelve months preceding the claim, or $50 USD, whichever is greater.

Termination

You may stop using the Service and delete your account at any time. Imparted may suspend or terminate your access if you violate these Terms, abuse the Service, or engage in fraudulent activity. We may also discontinue the Service entirely with reasonable notice.

Governing law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Benton County, Arkansas, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. Material changes will be communicated through the app or by email when reasonably possible. Continued use of the Service after a change means you accept the updated Terms.
